Minnesota: the Radon Awareness Act
If the home is in Moorhead, Dilworth or elsewhere in Minnesota, the Minnesota Radon Awareness Act applies. Before the purchase agreement is signed, sellers must give buyers a written disclosure of what they know about radon in the home (including any test results and whether there is a mitigation system), a radon warning statement, and a copy of the Minnesota Department of Health publication on radon in real estate. The law does not require a test, and it doesn't require mitigation.
North Dakota
North Dakota added a radon disclosure law in 2025 (N.D.C.C. 47-10-02.2). It requires sellers to disclose in writing any prior radon test results and evidence of mitigation they know about. Like Minnesota's law, it doesn't require a test. Many Fargo and West Fargo buyers include a radon test in their inspection anyway.
This is general information, not legal advice. Ask your agent or attorney how radon is handled in your purchase agreement.
Tips for buyers
- Order a radon test as part of your inspection, ideally a professional continuous-monitor test of at least 48 hours.
- If the result is 4 pCi/L or higher, buyers often ask the seller to install a system before closing or to provide a credit.
- If a system is already in place, check the manometer, the fan, and the date of the last test.
- For a system installed by the seller, ask for the installer's certification or MDH license, and the post-mitigation test.
Tips for sellers
- Testing before listing avoids a surprise in the middle of the deal. In Minnesota, any known result must be disclosed.
- If you install a system, keep the paperwork and the follow-up test result to show buyers.
- A documented, working system answers the radon question before it's asked.
Timing
A professional test usually takes at least two days, plus time for the report. Installs can often be scheduled within days and take part of a day. The follow-up test needs the system running at least 24 hours. Share your dates when you request a quote.
